Recently, after a three week trial, I obtained two not guilty verdicts on a robbery and attempted robbery case! Simply, robbery is the taking of personal property from another person by “force or fear” (Penal Code section 211). Carjacking and bank hold ups are two examples. The “force or fear” element can be met if the assailant either threatens bodily harm or has a weapon. However, prosecutors often over charge theft and or burglary charges as robbery cases!

Robbery convictions are “strikes” under the determinate sentencing law pursuant to Penal Code sections 667.5(c) and 1192.7(c)and accordingly have severe penalties and consequences attached to them including a mandatory prison commitment unless the judge is persuaded to not impose prison “in the interest of justice.”

Likewise, robbery charges usually have special sentencing enhancements attached to them, i.e. personal use of a knife or gun, to add additional time in prison. As the sentencing consequences are so draconian and long lasting, robbery cases must be thoroughly looked into including obtaining all witness statements and obtaining any videos of the incident.
